NICE (the company styles its name NiCE) licenses customer-experience software in two ways. NiCE CXone and related cloud services are subscriptions priced per agent, per user, per conversation or per unit of usage, with minimum commitments. On-premises Software is licensed to run on hardware the customer owns or controls, with annual support and a contractual right for NiCE to verify licence use.[2] All of it is governed by one set of Enterprise Terms and Conditions that apply to every Transaction Document, whichever NICE or Affiliate entity signs it.[2]
Editions
The NICE pricing page presents CXone as five suites listed per agent per month: Omnichannel Suite at USD 110, Essential at USD 135, Core at USD 169, Complete at USD 209 and Ultimate at USD 249, the last also shown as USD 0.25 per session.[1] The page says its pricing is billed monthly in arrears with no prepay, and describes a usage-based, tiered model.[1] Features are grouped under Engagement Orchestration, Workforce Empowerment, Agentic Experience Automation and an AI Platform, and each feature is marked Included, Add on, Consumption based or AI Ready.[1] Industry packages for banking, insurance, healthcare and retail carry the same USD 249 and USD 0.25 prices, and a government package starts at USD 2 per consumer per year.[1] Details are in NICE CXone suites and agent licence models. Metrics
The Cloud Services Terms of Use and Delivery Policy defines the two agent models:
- Configured User or Named Agent. The number of uniquely identified employees, agents, traders or contractors who have one or more interactions processed by the Cloud Services each month; identities may change as long as the number of users with monthly interactions stays within licensed capacity.[3] See Configured User.
- Concurrent User. The peak number of logged-in active Configured Users, calculated on the single highest volume day in a month and invoiced on the highest number of agents logged in at any time in the month, called the Peak Agent Amount.[3] See Concurrent User.
Other metrics apply to specific products: Conversations and Individuals for Cognigy-based AI agents, Concurrent Voice Gateway Sessions, offers for CXone Guide, hours of recorded audio per day for Nexidia analytics, and Attended or Unattended Use for process automation.[3] A Business Unit, defined as an independent, billable software instance of the Cloud Services, is the boundary within which the customer is responsible for all activity and charges, including telephony and network connectivity.[2]
Counting / floors
CXone commitments are expressed as a Minimum MRC (monthly recurring charges) or a Minimum ARC (annual recurring charges), excluding non-recurring charges and network connectivity, for the Subscription Term.[3] On a concurrent model, any Concurrent User above the minimum committed number is billed at NiCE’s then-current list price.[3] The Invoicing Policy describes the invoice rhythm for each model: the Minimum MRC monthly in arrears, or actual usage monthly and the Minimum ARC annually in arrears, with variance billed in the same cycle.[4] The terms add that Transaction Documents are non-cancellable and non-refundable, and that a customer that stops using the services remains liable for the rest of the term, including amounts subject to a minimum commitment.[2] See NICE CXone commitments, invoicing and renewal.
Virtualization & partitioning
The Cloud Services are hosted by NICE, so server virtualisation rules do not apply to them. For on-premises Software the Terms define Software as software licensed to the customer on hardware owned or controlled by the customer.[2] The documents reviewed for this coverage contain no virtual-machine or core-based counting rules for Software; quantities are those purchased on the Transaction Document.[5]
Cloud / BYOL
There is no bring-your-own-licence construct in the NICE terms. The licence is a non-exclusive, non-transferable, non-sublicensable right to use the Services or Software for the customer’s own internal business purposes, and the terms prohibit resale, benchmarking, load or penetration testing, and using AI to replicate the services.[2] Several CXone capabilities rely on third parties, such as speech and language model services in Cognigy-based AI agents, and the Cognigy product-specific terms state that the applicable terms of the third-party service provider apply to such services.[9]

AI features are licensed separately from the suite. The CXone help centre states that AI technologies in NiCE CXone require additional licences.[8]
Audits and compliance
For cloud services, compliance is mostly a matter of metering and invoicing: the customer must monitor its own and its users’ use for unauthorised usage and is responsible for activity under its account.[2] The liability cap does not apply to NiCE recovering payment for use of the Services or Software in excess of the quantity purchased.[2] For on-premises Software, the On-Premise Support Policy gives NiCE the right, on reasonable prior notice, to verify licence compliance and the quantity in use using a NiCE script that the customer runs and returns within ten days; excess licences are invoiced at NiCE’s then-current list price.[5] See NICE enterprise terms and software compliance verification and, for general practice, software licence audits and true-up. Out of scope
This coverage does not describe NICE Actimize, public safety, or other lines outside contact-centre and customer-experience software, CXone product-specific terms for telecommunications services (voice, SMS, network connectivity), partner resale pricing, or negotiated enterprise pricing. Product names such as CXone Mpower and Enlighten AI are not defined on the pricing and legal pages that were read and are therefore not described.
