Personio’s two supplemental terms add a billing unit and a set of customer duties to the base subscription. Personio Payroll is the payroll product, billed per employee per month. AI Features are the functions that use artificial intelligence, billed in AI Credits. Both sit on top of the General Terms and Conditions (GTC) and the Data Processing Addendum (DPA).[1][2]
Editions
Personio Payroll. The product page says it is “currently only available in Germany” and offers the plans Basic, Standard, Pro and Expert, “whether you’re self-managed or want full support”. The page describes it as a native payroll solution developed by Personio and not an integration of a third-party payroll provider, and says payroll is billed per employee per month with no hidden or additional costs for communicating with authorities, support access unlimited and included in the price.[3] A tax advisor can take part through an Expert programme.[3] The catalog lists the plans as Personio Payroll Basic, Personio Payroll Standard, Personio Payroll Pro and Personio Payroll Expert. No public price is stated; offers are individualised.[3]
AI Features. The supplemental terms define an AI Feature as any functionality in the Personio Software that uses artificial intelligence or machine learning technology to generate, summarise, classify or recommend content. AI Features are optional, and Admins can enable or disable a feature, or all AI Credit consumption, at any time in the admin settings.[2] Under the GTC, Personio does not use customer data to train AI models.[4]
Metrics
Personio Payroll user (employee per month). The unit is the employee and month, and a User Commitment applies. The terms say the commitment is “initially established in the quote documentation and subsequently can only be changed on renewal”, with notice no later than 90 days before the Personio Payroll renewal subscription date.[1]
AI Credit. “AI Credit” means the unit used to measure use of AI Features. A Wallet shows the combined credit balance. Bonus Credits are granted voluntarily and free of charge, may expire after 30 days, and have no monetary value and no entitlement to repetition. Prepaid Credits are added to the Wallet and may expire after twelve months or at contract end, whichever comes first.[2]
Counting / floors
Payroll billing. The billing period for subscription and implementation fees starts on the commencement date of the Personio Payroll Agreement and runs for one year unless the quote’s term is longer. The billing month runs from the 1st to the last day. The first invoice is based on the User Commitment, and later invoices are the commitment plus the previous month’s overage fee. The customer pays no less than the User Commitment subscription fee in any month. If more users are needed beyond the commitment in a month, overage is invoiced monthly in arrears at the same net rate per user. One-time fees are due in advance on receipt of an invoice.[1]
AI billing. AI Features are billed on a usage basis. When credits are used up the feature keeps working and further use is billed as Extra Usage monthly in arrears at the applicable rate, after in-product approval by an Admin whom the customer must ensure is authorised. Admins can set a Spend Limit; at the limit usage stops until the next billing period or until an Admin raises the limit, and a change takes effect immediately.[2] The GTC state that usage-based fees, including AI overage, are billed monthly in arrears in the month after use and that the payment duty for usage up to the end of the Agreement survives termination.[4] Unused credits lapse without compensation when they expire or when the feature is deactivated.[2]
Virtualization & partitioning
Neither supplemental term contains a hosting or partition rule. For payroll, the group-company rule of GTC Ziffer 6.2 applies “depending on the chosen Personio Payroll plan”, so use for affiliates depends on the plan.[1] The product is available only in Germany, so a payroll deployment is tied to German payroll and social-insurance processes; the page notes certification by ITSG for communication with social-insurance providers.[3]
Cloud / BYOL
Payroll requires an active subscription to a Personio plan; if the customer terminates the Personio plan, Personio Payroll ends in alignment.[1] Accounts that use Personio Payroll (or DATEV) cannot add apps in self-service and must contact Personio.[5] Payroll is implemented under an Implementation Plan based on Personio’s standard procedure, with kick-off meetings, information supply, set-up before the first payroll date and termination of prior payroll arrangements by the customer.[1] Out-of-scope activities are separate Professional Services under their own terms, billed on time effort or at a fixed price, with 15-minute invoicing units and 14-day payment.[1][6] Payslips are electronic only.[1] The customer is responsible for registrations and powers of attorney for filing, for designating at least two payroll owners and for approving the payroll before each run.[1] Personio does not act as employer or adviser, and its information is not legal, tax or accounting advice.[1]
Programs
- Personio Payroll implementation and User Commitment: implementation, User Commitment and overage rules above.[1]
- AI Credits, Wallet and Extra Usage: AI Credits, Wallet, Prepaid and Bonus Credits and Extra Usage above.[2]
- Change control: Personio may offer different plans; required changes for regulatory reasons or an unsuitable plan are notified at least 30 days ahead; if a change is not agreed and Payroll cannot be provided without it, Personio may terminate the Payroll subscription on three months’ notice.[1]
Audits and compliance
Payroll. The customer is responsible for accuracy, timeliness and completeness of the information it inputs and for notifying errors immediately. If Personio must rectify an error, additional fees may apply, but technical errors caused by the Software are corrected at no additional cost. Statutory and legislative reports and forms generally delivered by a payroll provider are included, and additional fees may apply to out-of-scope items.[1]
AI. The customer is solely responsible for checking output, keeping human oversight, giving required transparency notices, not using output to build a competing model, setting permissions for AI Actions, and meeting deployer duties under applicable law including the EU AI Act. It may not use output as the sole basis for a decision with legal or similarly significant effect on an individual, including recruitment, performance, compensation and termination. If an AI Feature is high-risk, such as recruitment screening, the customer becomes a deployer by activating and using it. An AI Action carried out in the customer’s environment is deemed the customer’s own action.[2] Personio does not use the customer’s data, input or output to train or improve models, and it does not warrant that output is accurate, complete or free of third-party intellectual property rights.[2]
Out of scope
Prices for Personio Payroll and AI Credits, the Implementation Plan, the Order Form and Personio’s responsibilities for payroll filings with authorities beyond the terms are not covered. Payroll outside Germany is not offered through Personio Payroll according to the product page.[3]
