- "If Customer’s actual usage exceeds the quantities purchased under the applicable SOF for two (2) consecutive calendar quarters or for three (3) calendar quarters in any rolling twelve (12) month period (such pattern, “Chronic Over-Usage”), such excess usage shall be deemed authorized and Customer shall pay the applicable fees for the excess quantities at the rates set forth in the applicable SOF."
