Instructure AI, Mastery, Parchment and Elevate supplements

This article is about the product Supplements to the Instructure Master Terms (Artificial Intelligence, Intelligent Insights, Mastery Item Bank, Mastery View Assessment, Elevate, Elevate Standards Alignment, LearnPlatform, Parchment and Digitary). It is not about the Master Terms themselves.

On This Page

The Instructure Master Terms and Conditions are supplemented by ten product documents, listed on one index page. Each is incorporated into the Order Form and Instructure’s Master Terms, and capitalised terms not defined in a Supplement take their meaning from the Master Terms.[13] Where a Supplement contradicts the Master Terms on the same subject, the Supplement ranks above the Master Terms and below the Order Form.[11] This article covers the nine product Supplements; the tenth, Professional Services, is covered in Instructure Master Terms and user count verification.

AI Features. “AI Features” means Instructure’s or a third party’s AI, generative AI or machine-learning technology that uses inputs to predict outcomes or generate content, is part of the Service and “is enabled by Customer within Customer’s account”.[1] Usage limits are specified in the Order Form and documentation and may be expressed as credits, transactions or other consumption metrics. Non-agentic features must follow “reasonable usage patterns in the ordinary course of business”; if usage materially exceeds typical levels or places disproportionate demand on the platform, Instructure may temporarily suspend or limit access for the affected user or customer and will use commercially reasonable efforts to notify the customer.[1] Agentic features have specific limits, “including any limits expressed as credits per billing metric per subscription year”, and if the customer exceeds the credits Instructure may suspend access until the customer signs an Order Form for more credits at then-current rates and/or pays an invoice.[1] Instructure launched IgniteAI Agent initially in the United States and Latin America on 2026-03-12 and pointed users to the AI Supplement for the applicable terms.[3] The documents do not publish the number of credits, the billing metric or the price of a credit; those are Order Form terms. A licence manager should record which AI Features are enabled, because the definition ties the Supplement to features the customer has turned on.

Mastery content. The Item Bank License is for “noncommercial purposes and only for students registered within Customer’s schools/district(s) (the ‘Territory’) for the sole purpose of performing formative assessments of those students”.[4] Customers may not use it unless they are a United States elementary, middle or secondary school or district, a state education agency or state-authorised service centre, or a school outside the United States using a United States-based curriculum for English-speaking students, and may not promote items as high-stakes assessments such as graduation tests, college admissions tests or teacher evaluations.[4] Instructure may modify the item banks and require deletion of specific items, and on termination the customer must stop using the item banks and all derivative works, including printed copies.[4] Mastery View Assessments may not be shared, duplicated or reproduced; use is limited to registered students “during the academic year in which the Mastery View Assessments are initially delivered”, and loading assessments or single questions into another item bank or platform “community boards” is prohibited.[5]

Parchment. A “Request” means digitally requesting “the issuance and transmission of one Credential electronically to one Credential Recipient”, and credentials include licensed transcripts, diplomas, certificates, degree or enrolment verifications, digital badges and custom CLR credentials.[9] Certain services “may be paid for on a per-transaction basis by individual Credential Owners or Credential Requestors” where the Order Form indicates it; Instructure then acts as merchant of record and refund costs fall on Instructure for technical errors and on the customer for data errors or failure to fulfil.[9] Print and mail fees are paid by the owner or requester at Instructure’s then-current market rates.[9] Several cross-references in this Supplement point to section numbers of an earlier Master Terms layout. For example it refers to “Section 16.1” for indemnity while the current Master Terms refer to “Section 17.1”, so a licence manager should read it against the Order Form.[9][11]

Digitary. The customer must “maintain a written, up to date list of current Authorised Users” and give it to Instructure within five Business Days of a written request. Master Terms clause 7 does not apply to Digitary Services.[10] For the Registered Organisation module the Annual Fee “is determined on the basis [of] the volume of Academic Records received”. If the actual annual volume falls in a higher Tier the customer may be invoiced the higher Tier fee less the fee already paid, and later years are classified at the higher of the selected Tier or the previous year’s actual volume.[10] This is the most explicit metered true-up in Instructure’s public documents. Tier thresholds are not published.

Virtualization & partitioning

Not applicable. All of these are hosted services or content licences. The restrictions that do appear concern who may use content: the Mastery Territory, Elevate’s End Organization and the Parchment and Digitary recipient roles.

Cloud / BYOL

Instructure hosts the services. The AI Supplement notes that AI Features may be Instructure’s or a third party’s, and Instructure reserves the right “with or without notice” to suspend or discontinue AI Features in response to changes in law, regulation or policy.[1] The IgniteAI Agent announcement states that it is powered by Amazon Web Services, specifically Amazon Bedrock.[3] The API Policy separately prohibits connecting through MCP servers not approved by Instructure; see Instructure support, API and partner terms.

Programs

  • AI usage limits. Credits for agentic features and reasonable-use rules for others.[1]
  • Parchment per-transaction payment. Individual requesters pay per transaction where the Order Form says so.[9]
  • Elevate Data Sync. The customer may access the Platform and the Instructure Components for the Term as part of the Integration Solution and must not “assign or sublicense” them except to create accounts for the End Organization. An End Organization keeps the right to disable or limit the customer’s access to its data, and Instructure may suspend the Platform if use goes beyond the permitted scope.[6]
  • Elevate Standards Alignment. A customer may let its clients use the curriculum standards and content management systems only with the customer’s own products, and may share a Global Unique Identifier only with a client that “has purchased a current license to use such Global Unique Identifiers from Instructure”.[7]
  • LearnPlatform Evidence as a Service. Research studies evaluating customer products against the Every Student Succeeds Act. Instructure does not warrant that results meet an ESSA tier, owns the deliverables and results, and the customer may use an ESSA Badge only in line with Instructure’s quality standards.[8]

Contract terms

Training and data. Unless the customer approves, Instructure “shall not use Customer Content to train, develop, fine-tune, improve, or otherwise enhance any AI Features”. The customer may not use AI Features or their outputs to create, test or improve any AI or large language model, and may not “share, resell, sublicense, or otherwise make available any AI Features” to a third party or circumvent an AI usage limit; violation is a material breach.[1] Output based on Customer Content is Customer Content to the extent the law permits, but prompts typed directly into AI Features, and data and analytics derived from them, “constitute Usage Data and are not Customer Content”, and Instructure may use that Usage Data for all purposes the Agreement permits.[1] The Intelligent Insights Supplement sets a parallel no-training rule for that product, leaves the choice of who can use Ask Your Data to the customer, and recommends administrative-level users only.[2]

Human review. The customer must ensure human oversight and may not use AI Features “to make fully automated decisions” with significant effects on individuals without meaningful human review.[1]

Mastery Item Bank. Third-party content in the item banks may lapse during the term, because Instructure’s rights in it may not extend to the Territory or may expire.[4] The product page notes that predictive end-of-year outcomes are “not available in all states”.[12]

Out of scope

  • Prices, credit conversion rates and Tier thresholds, none of which are published.
  • The Scribbles product terms, which share the Parchment Supplement but were not separately analysed.
  • Digitary support terms and data protection addenda, which are linked rather than reproduced.
  • Third-party AI model terms that apply to features Instructure runs on partner platforms.
  • Canvas Studio, Catalog, Career and Impact, which have no separate Supplement and are covered by the Master Terms and the Support Terms.
