- “Notwithstanding the foregoing, Kong will have no obligations under this Section if the claim is attributable to: (1) any modification of the Products not made by Kong or its contractors; (2) any combination or use of the Products with products or services not provided by Kong, if the claim would not have arisen but for the combination or use; (3) Customer’s failure to use Updates made available by Kong at no additional cost; (4) use of the Products not in accordance with this Agreement; or (5) Third Party Open Source.”
