The Midjourney Terms of Service (version effective 27 May 2026) and the billing support articles are the contract documents for every Midjourney customer. The Terms apply to the services reached through midjourney.com, Discord servers or any other means, and together with the Subscription Plans page and the Community Guidelines they form a single binding agreement. The agreement takes effect when the customer is presented with it and proceeds to use or access the Services, and it may be updated and presented again, with continued use constituting acceptance.[1]
Editions
The Terms do not distinguish editions, except for the Pro and Mega requirement and Stealth Mode described in Midjourney commercial use, ownership and Stealth Mode. Plan editions and prices are in Midjourney plans and GPU time.
Metrics
The only unit in the Terms is the account. Only one user may use the Services per registered account, and each user may only have one account.[1] See Account (one user). Users must be at least 13 years old and meet the minimum age of digital consent in their country; a younger user needs a parent or guardian to agree to the Terms.[1]
Counting / floors
Organisations. Midjourney states that it does not offer discounts or free plans to organisations, including non-profits and educational institutions. For organisations that need 50 or more yearly Pro or Mega plans, support can arrange bulk billing, which carries no additional discount beyond the standard yearly price. The page lists what is not offered: seat or admin management, terms and policy negotiation, SSO logins and participation in vendor, supplier or security processes such as signing organisation-required forms.[2]
Fewer than 50 plans. An organisation below that number cannot get a single invoice. It subscribes each account through the standard channels, and the page recommends contacting billing support after the first account with the invoice number, the total number of accounts needed and a short description of use. Each account needs a unique billing email under the organisation’s web domain, and billing support cannot provide information about individual accounts later, so the page recommends keeping a register of each user’s name, login email and Midjourney ID.[2]
Schools. Each student needs their own account and subscription. Midjourney does not offer shared accounts, group plans or school-managed student accounts, although a school can reimburse students if the subscription stays under the student’s control.[3] See Educational use.
Transfers. A subscription and image history cannot be transferred. Where a user has lost access to the Discord or Google login behind the account, Midjourney support may in some cases offer a credit transfer to a new account, but the gallery and history do not move.[4]
Virtualization & partitioning
Not applicable.
Cloud / BYOL
Not applicable.
Programs
Free trial. A limited trial exists only on the niji journey mobile app, not on Discord or the website.[5]
Subscribing. The customer subscribes on the Manage Subscription page, pays through Stripe, and receives an invoice and receipt at the billing email entered at checkout, which can differ from the login email. Changing that email later needs billing support, and issued invoices cannot be changed, so organisations should check invoice details at checkout.[6]
Contract terms
Use restrictions
The Terms prohibit using the Services to develop or offer competitive products or services, reverse engineering the Services or Assets, using automated tools to access, interact with or generate Assets, and reselling or redistributing the Services or access to them.[1] They also prohibit using the Service to violate others’ intellectual property rights, with penalties that include legal action or a permanent ban.[1] Midjourney can suspend or ban access at any time and for any reason, and the Terms say it does not guarantee quality, stability, uptime or reliability and asks users not to create dependencies on the Services or Assets.[1]
Billing and cancellation
Midjourney may invoice through a third party payment provider, whose terms govern payment processing if they conflict with the Terms. A customer can cancel at any time and is not refunded for the current period but is not charged after it ends. Midjourney can change or discontinue any aspect of the service, including pricing and features, and can terminate access for any reason, including Community Guidelines violations.[1] A cancellation takes effect at the end of the billing cycle.[7]
A refund is available only if the account has used less than 20 GPU minutes in its lifetime across Fast, Turbo and Relax time. The option appears automatically when cancelling, and refund eligibility does not apply to accounts suspended or terminated for violating the Terms or the Community Guidelines.[8] Purchased Fast hours are non-refundable.[9] See Refund only below 20 GPU minutes used.
Disputes and liability
Disputes are to be resolved by binding arbitration under the American Arbitration Association’s International Centre for Dispute Resolution Expedited Commercial Rules, with one mutually selected arbitrator, in English in Santa Clara County, California, after 30 days of good faith settlement efforts. The parties waive jury trial, each bears its own legal fees, and either may seek court injunctive relief pending arbitration.[1] Midjourney’s aggregate liability is capped at the amount paid for the Services giving rise to the claim in the 12 months before the claim, and the customer indemnifies Midjourney, its affiliates and personnel against third party claims arising from use of the Services and Assets or violation of the Terms. Any cause of action must start within one year after it accrues.[1] California law governs.[1]
Copyright notices
The Terms set out DMCA takedown and counter-notification procedures through a designated agent in South San Francisco, and say Midjourney may terminate users who repeatedly infringe.[1]
Audits and compliance
The Terms contain no licence audit clause. Enforcement is by suspension, ban and investigation of complaints, with disclosure to law enforcement or regulators where Midjourney considers it appropriate.[1] A customer’s controls should therefore concentrate on account hygiene: an account register as the group billing page recommends, one user per account, no automation or scripting, no resale of access, and a documented owner for each subscription and renewal date.
