Leica Cyclone licensing covers the reality capture software that Leica Geosystems, part of Hexagon’s Geosystems business, sells for laser scanning data: capture, registration, modelling and publishing. Hexagon’s agreements page lists the Software License Agreement - Terrestrial Laser Scanning among the Geosystems documents, alongside a general Hexagon Geosystems Software License Agreement in several languages.[5] The licensor is Leica Geosystems AG of Heerbrugg, Switzerland.[1]
Editions
As of 2023-01-01, Leica restructured the Cyclone REGISTER licences. Cyclone PUBLISHER features became standard in Cyclone REGISTER 360 and its BLK Edition, which were renamed Cyclone REGISTER 360 PLUS and Cyclone REGISTER 360 PLUS (BLK Edition). Cyclone PUBLISHER Pro was renamed Cyclone WORKFLOW.[2] Leica described the change as a free upgrade for all users, including those without active CCP.[2]
| Product | Licence requirement or bundling |
|---|---|
| Cyclone REGISTER 360 PLUS | Permanent licence or active subscription[2] |
| Cyclone REGISTER 360 PLUS (BLK Edition) | Permanent licence or active subscription of the BLK Edition[2] |
| Cyclone FIELD 360 | Included free of charge with Cyclone REGISTER 360 PLUS; the BLK Edition with REGISTER 360 PLUS (BLK Edition); Quick Plan is an optional add-on[3] |
| TruView desktop viewer | Free[3] |
| TruView Cloud | Publishing requires an active TruView Cloud subscription[2] |
Publishing rights depend on the licence held. Publishing to Cyclone ENTERPRISE requires Cyclone REGISTER 360 PLUS, Cyclone JetStream PUBLISHER or Cyclone TruView PUBLISHER. Publishing to RCP requires Cyclone REGISTER 360 PLUS 2023.0.0 or later. JetStream PUBLISHER and TruView PUBLISHER are discontinued.[2] An entitlement review should therefore record which publishing licences remain in use, since the discontinued ones will not be replaced in kind.
Metrics
The agreement grants “the non-exclusive, non-transferable, non-sublicensable, and non-assignable right to use … the Software on one (1) application, unless the number of permitted applications is otherwise agreed upon in the Purchase Agreement”.[1] The licensed application is the base unit. The software may be installed and run only on the “Specified Computer Facility”, which is the computer or server environment defined in the product description.[1]
Some Leica software contains a “Special Program” that “regulates and monitors the number of simultaneous users of the Software in a network environment together with the number of the licensed copies”. The licensee consents to it and may not circumvent it.[1] For Cyclone 3DR, the installation guide describes floating licences activated in the Client License Manager (CLM) for Floating Licenses with an Entitlement ID (EID). Users then check out the features contained in their EID from a local CLM or a dedicated licence server. “Be sure to choose the CLM Floating option (there are two CLM options and the Nodelocked CLM will not activate your license).”[4]
Counting / floors
No minimum quantities are published. The restrictions in section 2 define what counts as additional use. Without Leica Geosystems’ prior written consent, the licensee may not use the software:[1]
- on a computer facility other than the Specified Computer Facility;
- on more than one work station;
- on networks or on a client server system;
- on mobile additional instruments.
The licensee may make one copy for security and archiving. For an update or additional module, it may make only as many copies as previously authorised.[1] Installation and continued use may require an entitlement number, and registration may be required before one is issued.[1]
Virtualization & partitioning
The agreement does not mention virtual machines. Moving software between computers is controlled technically: “The activation security mechanisms may disable the Software if Licensee attempts without Leica Geosystems’ consent or authorization to transfer it to another computer or device”. The same applies if the date settings are tampered with or the software is used past an evaluation period or limited term.[1] Passing the software to a third party, including by lease, loan, sublicence or “via a service bureau”, needs prior written consent.[1] The software may connect automatically to the internet to communicate with Leica Geosystems.[1]
Cloud / BYOL
Cyclone ENTERPRISE, JetStream and TruView are publishing destinations rather than separately counted licences in the cited documents. TruView Cloud is a subscription service.[2] No bring-your-own-licence terms for public clouds were found.
Programs
The cited documents name two programs: subscriptions as an alternative to permanent licences, and the CCP referred to in the Cyclone licensing notes.[2] Hexagon publishes General Terms and Conditions for Customer Care Packages among the Geosystems agreements.[5] The licence agreement itself provides a warranty. Defects in the software must be notified within one year of delivery, and defects in the data carrier within 90 days. Leica’s remedy is replacement, repair (including updates or work-arounds) or termination with a refund.[1]
Third-party and open source components
The licence covers Leica Geosystems software and any Third-Party Software named in the attached Integrated and Resale Software Supplemental Terms. Where the two conflict, the Supplemental Terms govern for the third-party software.[1] Other third-party software is not covered and is governed by its own provider’s terms. The licence also applies to open source software, but “In case of conflict with the terms of this Software License Agreement, the terms of the respective OSS license agreement shall govern.”[1] Hexagon publishes a separate list of third-party software for Leica terrestrial laser scanning products.[5] For an inventory, components bundled with Cyclone may therefore carry obligations that do not come from the Leica agreement.
Term and termination
The agreement runs “for the term indicated in the Purchase Order”. Either party may terminate immediately for a material breach, including non-payment, that is not cured within 45 days of written notice, or for insolvency.[1] “On any termination of this License Agreement, all rights of use of the Software held by Licensee shall expire.” Within 30 days the licensee must return or destroy the software, copies, modified parts and security devices, and confirm in writing.[1] Swiss law governs, with courts at Leica Geosystems AG’s headquarters in Balgach. Leica may also sue at the licensee’s domicile.[1]
Audits and compliance
The agreement has no separate audit clause. Compliance relies on product activation, entitlement numbers and the Special Program. The licensee must take all reasonable steps to prevent unauthorised use or copying and must indemnify Leica Geosystems for infringements it causes.[1]
