picturemaxx

picturemaxx AG, based in Munich, makes digital asset management and image marketplace software for publishers, picture agencies and corporate users. It licenses its software under its general terms either permanently or for a limited term, in-house or as a hosted service (ASP).

  1. The picturemaxx general terms (AGB) apply only to business customers and cover permanent software licences, time-limited licences (in-house or ASP), update and support contracts, the picturemaxx media network and push services.[1]

  2. Under a permanent licence, simultaneous use of the software on several workstations in a network or client-server setup is allowed only up to the agreed number of workstations or clients.[2]

  3. Time-limited licence contracts can be terminated by either party with three months' notice to the end of a contract year, unless agreed otherwise.[3]

  4. Passing the login password on to third parties is grounds for extraordinary termination of ASP contracts, and on termination the customer must delete all program copies; picturemaxx may request a sworn declaration of this.[4]

  5. For hosted services, stored data volume is determined from measurements for monthly billing.[5]
