Forcepoint

Forcepoint makes data security and network security products, including DLP, DSPM, web and cloud access security, next-generation firewalls and SD-WAN. Its products are sold as subscriptions (and, for network security software, licences with maintenance) measured against a Permitted Capacity of devices, users, seats, throughput or other metrics set out in the order and the Solution Rider.

  1. Forcepoint publishes separate end-user terms for its products: a Subscription Agreement, a Network Security EULA, a Solution Rider, a Cloud/SaaS Service Level Agreement and a Mobile App Subscription Agreement.[1]

  2. The Subscription Agreement grants a limited, non-exclusive, personal, nontransferable right to use the Products for the Subscription Term, solely for the subscriber's internal business purposes up to the Permitted Capacity.[2]

  3. Permitted Capacity is the number of Devices, Nodes, Seats, Throughput, Users or other licence metrics set out in the Order or the Solution Rider; use above it must be covered by buying additional capacity for the balance of the term.[3]

  4. Under the verification clause, Forcepoint or its independent auditor may review the subscriber's records, systems and personnel during the Subscription Term and one year after; if additional fees are due, the subscriber reimburses the verification cost and pays at then-current list price without discounts.[4]

  5. The Network Security EULA grants a licence (and where applicable a subscription) to the software identified in the order plus Cloud Services for the Subscription Term, for internal business purposes up to the Permitted Capacity, with Maintenance bought for a Maintenance Term.[5]
