AvePoint

AvePoint makes the AvePoint Confidence Platform for Microsoft 365 and cloud data backup, governance and migration. It licenses its solutions mainly by subscription, priced by user count or by the amount of data protected or migrated, under a Master Software License and Subscription Agreement.

  1. The AvePoint Confidence Platform is sold on a subscription basis; depending on the product, pricing is based on user count or on the amount of data to be protected or migrated.[1]

  2. Term licences can be granted per user, per named domain, per usage (the number, size or amount of data processed) or per locality, as specified on the order.[2]

  3. Perpetual licences can be limited per SharePoint Server administered, per usage or per named domain; perpetual licence customers may buy Premier, Standard or Basic support, while subscriptions include Premier Support during the term.[3]

  4. If a customer exceeds the subscription quantities on its order, AvePoint invoices the excess usage at the then-current undiscounted unit price, co-terminous with the initial subscription term.[4]

  5. Licences are non-exclusive, non-transferable and for internal use only; the customer may not assign the agreement without AvePoint's written consent except in a sale of all or substantially all of its stock or assets.[5]

  6. AvePoint publishes separate versions of the agreement for each contracting entity, including the US, Public Sector, Australia, Canada, Germany, Japan, Korea, Singapore and UK entities.[6]
